Mark Ellis practices white-collar criminal defense, commercial litigation, and other criminal and civil litigation in federal and state courts. Mr. Ellis represents clients in all stages of litigation from investigations through trials and appeals, as well as in arbitration and mediation.

Mr. Ellis graduated from the University of Pennsylvania, cum laude, in 2001 and Brooklyn Law School in 2005. He trained as an intern in multiple prosecutors’ offices including the U.S. Attorney’s Office for the Eastern District of New York. He began practicing law in 2005 at Simon & Partners LLP before joining Jacob Laufer, P.C. in 2011.

Mr. Ellis’s work has yielded many successful outcomes, including these representative cases:

  • A construction company and its owner were threatened with federal prosecution in the Eastern District of New York, but a detailed presentation to the government led to the investigation being closed with no criminal prosecution;
  • A life insurance broker was faced with federal prosecution (as part of an industry-wide investigation) in the District of New Hampshire, but his advocacy led to the government declining prosecution in favor of a modest civil settlement;
  • A defendant, in a federal criminal case (who pled guilty to bank fraud) in the Southern District of New York, faced a Sentencing Guidelines range of 41-51 months, but received a sentence of probation;
  • Won an appeal to the Second Department, Appellate Division in a civil fraud action to recover client’s funds related to a South American investment, resulting in a seven-figure civil judgment and recovery from the defendants;
  • Conducted a trial in State Supreme Court of a civil fraud action to recover funds related to a real estate investment, resulting in a settlement involving substantial payments from multiple defendants;
  • Conducted an internal investigation on behalf of a major New York hospital of allegations involving wrongful distribution of prescription medicines, which effectively cleared the subjects of the investigation;
  • Represented a defendant charged in State Supreme Court with a Class B felony (involving alleged embezzlement) who faced both a substantial jail sentence and professional licensing revocation, but received a non-criminal disposition, no licensing consequence, and a modest civil payment.

Over his fifteen year career, Mr. Ellis has represented – in various capacities – large organizations (including a hospital chain, several well regarded charitable and religious organizations, and a municipality), executives at substantial companies (including a Fortune 500 company), noted figures (including a prominent New York politician), and clients in noteworthy and newsworthy cases (including cases brought by 9/11 detainees, cases alleging sexual abuse within religious institutions, organized crime, and murder.)

Mr. Ellis served on the Criminal Law Committee of the Association of the Bar of the City of New York. He also served as Team Leader on multiple volunteering projects for New York Cares.
